State WC Programs

Under State WC Programs & Evaluation of WC Programs in the Wiki, it states that for partnership, "state defines benefits, but private insurers write policies" and I don't believe this statement is entirely correct. The source states that "Employers can obtain workers compensation coverage to provide benefits to their employees by purchasing insurance from a private carrier or a state workers compensation fund, depending upon the options available in their state. They can also use self insurance."

  • The distinct categories of state provision of WC insurance are exclusive, competitive and none.

    The text defines "partnership" this way:

    ". . . Where private insurers may sell workers compensation, a public-private partnership exists since the benefits are established by state law, but insuring those benefits is the role of private insurers. "

    All states prescribe statutory WC benefits. So, where state provision of WC is competitive or none, this partnership exists. This is also the definition for partnership in the wiki.

    2016.F.7 looked for partnership as one of the three levels of state participation in WC. It certainly is a level of participation, but it's not a category of provision.
